Acknowledgement
You, individually and on behalf of the company/business, agree:
1. EasyPay will rely on the information provided in this Application in its evaluation of the company's/business's request;
2. you hereby warrant and represent that this information and any other information that may be supplied to EasyPay represents a correct, complete, and accurate disclosure of all requested information on the company/business and does not omit any information, the omission of which would make the disclosed information misleading;
3. the information also includes, whether requested or not, information that would materially impact the financial data furnished;
4. EasyPay is hereby authorized to share credit information about the company/business with all persons permitted, identified in the Master Agreement, or required by law;
5. EasyPay is hereby authorized to perform required due diligence on owner(s) and business/company including, but not limited to, reference calls, background checks, and obtaining consumer and other investigative reports from credit reporting agencies and other sources EasyPay deems necessary to complete its review;
6. law enforcement agencies, federal, state, and local agencies and courts, credit bureaus, information bureaus, financial institutions, licensing agencies, governmental agencies, and other individuals and entities are hereby authorized to provide any and all information that is requested by EasyPay;
7. you understand that knowingly providing false or misleading information to EasyPay or any of its officers or representatives may constitute a criminal offense and the Master Agreement with EasyPay may be immediately terminated by EasyPay at EasyPay's sole discretion;
8. you acknowledge that the person signing below has the right, power, and authority to enter into, sign, and bind, in each case on behalf of the company/business, this Application and the Master Agreement and to provide all necessary information for the company/business to qualify as a Merchant under the Master Agreement;
9. you acknowledge that the company/business has the right, power, and authority to perform the obligations in this Application and the Master Agreement; and
10. this Application is subject to the terms and conditions provided in the Master Agreement, including but not limited to your consent to receive email, text, and voice messages and to use electronic signatures as originals.
Agreement to the Merchant Master Agreement
By signing below, on behalf of the Merchant, I agree to and accept the EasyPay Merchant Master Agreement (EasyPay Merchant Master 08_2023 v1.0), together with its Program Exhibits (Exhibit A — Third-Party Loan; Exhibit B — Credit Sale; Exhibit C — Lease-to-Own), which are incorporated herein by reference and available to read in full at the link above. I understand the Master Agreement contains important terms, including indemnification (Section 10), limitation of liability (Section 11), disclaimer of warranties (Section 12), reversals and refunds (Section 14), termination on thirty (30) days' notice (Section 15), a reserve account, right of set-off and limited power of attorney (Section 16), and a binding arbitration provision with a class-action waiver (Section 23).
Electronic Signature Consent (ESIGN / UETA)
I consent to use an electronic signature and to receive records relating to this enrollment and the Master Agreement electronically. I agree that my electronic signature below is the legal equivalent of my handwritten signature, is binding, and may be relied upon as an original. I confirm I am able to access and retain this record electronically.
